Court: Jail tapes obtained improperly in school killing:

The Supreme Judicial Court of Massachusetts has ruled that the jailhouse conversations between John Odgren and his family and fried were obtained improperly by prosecutors.

Odgren is accused of stabbing and killing James Alenson in the bathroom of Lincoln-Sudbury Regional High School. The defense is saying that Odgren is insane because he has Asperger’s. The prosecution says the tapes show that Odgren is far from insane.

Even though the court said that the conversations were obtained improperly they also said that this doesn’t mean that the conversations can’t be used at trial.

That decision has been left to a lower court.
