Michael Jacques’ attorney seeks dismissal of kidnapping charges:
Michael Jacques’ anti-death penalty attorneys have filed a motion to have the kidnapping charges against him dismissed.
Jacques’ lawyers claim that the law used to charge him with federal kidnapping is unconstitutional. As you may know, Jacques’ is accused of kidnapping, molesting and killing his 12-year-old niece Brooke Bennett. Jacques allegedly altered Brooke’s MySpace to make it look like she ran away. While Brooke was never taken out of the state of Vermont he was charged with a federal crime since he used the internet to commit and cover up his crime. Vermont, however, does not have the death penalty but the federal government would like to put Jacques to death and I don’t blame them.
His lawyers say that the feds can’t even prove that Jacques kidnapped Brooke. They may want to stick with the unconstitutional angle. I think the feds have plenty of evidence that he kidnapped and killed Brooke.
