I’m thinking of calling this site Last Week’s News since I’m so far behind.

Anyway, last week a U.S. District Court Judge ruled that federal prosecutors can pursue the death penalty against Michael Jacques. As you may know, Jacques is accused of kidnapping, raping and killing his 12-year-old niece, Brooke Bennett.

Jacques has a defense team made up of anti-death penalty lawyers and they had argued that the death penalty is unconstitutional. The judge ruled that…

…the Second Circuit (Court of Appeals) and the Supreme Court precludes this court from holding the federal death penalty unconstitutional based upon the risk of executing the innocent,”

The crimes took place in Vermont which does not have a death penalty but since Jacques used MySpace and the internet to allegedly commit the crimes it became a federal case.

The judge also ruled that the trial will not be moved out of Vermont.

The trial is set to take place in September of 2011, three years after Brooke’s brutal murder.

I’ve said it before and I’ll say it again that scum like Jacques are more than deserving of the death penalty.
