Kidnapping Charge Tossed In Missing Boy Case:

This past Monday a judge threw out the kidnapping charge against Ernesto Gonzalez. He is the father of Giovanni Gonzalez who has been missing since August of 2008.

Quick recap, a then 5-year-old Giovanni spent the weekend with his father in Lynn, Massachusetts. When it came time to be returned to his mother Ernesto Gonzalez said he didn’t know where Giovanni was and hasn’t given his location since. Ernesto Gonzalez has claimed that he killed his son but police say there is no evidence to support that.

In the most recent development, a Superior Court judge threw out the kidnapping charge against him stating that Ernesto Gonzalez did have parental rights to Giovanni since he had paid some child support and filed for joint custody.

However, not all is lost. Ernesto Gonzalez is still sitting in jail on a charge of lying to police.

Meanwhile, Giovanni has yet to be found and has yet to garner any media attention outside of the Massachusetts media and a brief AMW mention.

I ask that you please post this story on your Facebook or Twitter accounts or e-mail the national news networks to help get Giovanni’s story out and maybe this story can have a happy ending.

  1. Just because they don’t believe there is evidence that he was killed, why all of a sudden would they decide to NOT look into him being killed? I mean almost 3 years and they have no trace of the boy whatsoever? That in itself sounds kind of suspicious to me.

    1. Let me rephrase that. There’s no evidence that he killed him in the way he claims. 

    2. Did any of your rocket scientists ever bother to think that the cops know his murder story is complete BS?  That the only reason why he is saying ‘murder’ is in the hopes that the cops will stop looking for this kid – a kid that he has stashed away somewhere with a friend or relative?

      Oh, but that would make too much sense.

    I dunno, but could the state have a law similar to Texas’s “No body = no murder” law?

    1. You’re a moron.  There is no such thing as a No body = no murder law in Texas.  What a completely stupid thing to say!

      I’m an ADA in Texas and have seen a few prosecutions – successful prosecutions – in which no body was ever found.  Circumstantial evidence is still evidence that a jury can rely upon to convict.

      2. You know t_retz, I post the stories about Giovanni Gonzalez in order to bring some attention to the case of a missing child that is sorely lacking the attention that it deserves.

        Rather than being an asset to the story, which you could have been, you are an arrogant ass who brings nothing to the table but an unneeded attitude. Rather than lashing out with bile you could have politely explained how a murder prosecution with no body works in Texas but instead you lorded your supposed position as an ADA over everyone.

        If you really are an ADA with that kind of arrogance it explains why so many child molesters and abusers get off with such light sentences. You’re too quick to make a deal in order to pad your record instead of caring about actual justice.

        Actually read better twit – I said similar. For I recall there was a murder case in Texas where they had to prove the murder took place due to the insane amount of blood left at the crime scene, but the victim’s body was never found.

        I reread the case, and it was because of this murder – Thomas Fisher did his wife in Bextar County, Texas – that the law was changed in November 7, 1998 – the new law (851 SW2d 298) no longer requires  a body for the charge.

        So bite me, yes there was a time when a body *was* required to prove murder – and I remembered this case, but I forgot that this case changed the law. (And just to add spite, I’m not a Texan native!)

  8. I see this case on a regular basis, on the internet.  I can’t believe they have no real idea after 3 years.
    This bugs me on so many levels.  How can a father just say “oops, he’s not here” and get away with it.  If he stashed him somewhere, shouldn’t there be some sort of trail.  Did he travel?  Have family somewhere?
    Isn’t there some sort of law against misplacing your child?  Can I just tell my ex, sorry, they aren’t here and refuse to let them go ever again?
    I think if you can’t show where your child is, it should be some sort of major crime.  Interferring with the other parent’s right to custody is a crime in most places.

    1. Yes, isn’t it just a shame the police can’t get a pair of jumper cables, attach them to a car battery and his nads and get the truth out of the game playing piece of crap?
