I received this an e-mail from a Michael Stogner. It’s also posted at the San Mateo Daily Journal Community Forum. Mr. Stogner writes…

Subject: Equal Justice, San Mateo County Style, $3,000,000.00 Bail vs None

Currently we have 2 cases in our courts. One an 18 year old female child/young adult, the other a mature male who works for the Federal Government. Both cases involve cars and causing damage to property and persons.The difference is the 18 year old girl did the right thing after crash. She stayed at the scene of the accident.She did not run away, she did not hide. She has a $3,000,000 bail set in her case, some say that is excessive, her actions caused the deaths of three people, but her actions after the crash show she did the right thing.

The other case the man did the wrong thing, he smashed his car into another car with a woman in it, he refused to give her his license and insurance information and fled the scene of the crash. His license plate remained at the crash site. Six days later he reports to the Belmont Police Department….SIX DAYS. Belmont Police recommend he be charged with Felony Hit and Run, with Personal Injury. There is no evidence he has been arrested, No Bail Set, and the District Attorney’s Office under the leadership of James P. Fox charged him with a misdemeanor, not the felony.

Doesn’t look like Equal Justice

The first case Mr. Stogner is referring to is the case of Edith Delgado, the 18-year-old California girl who killed three members of the Tongan royal family after she crashed into their SUV while she was racing another car.

In the second case, as far as I can tell, no one died or was injured.

Mr. Stogner, Edith Delgado did not do the right thing. She was illegally racing and is responsible for the deaths of three people. $3M bail is not unreasonable. The man mentioned in the second case should have been arrested and charged with a felony but in no way do I believe he should have been given $3m bail. You’re comparing apples and oranges. Or in this case vehicular homicide with a fender bender.

    FROM READING HIS MYSPACE PROFILE AND WHAT HE HAS TO SAY ABOUT HIS SELF I WOULD SURE HOPE SHE HAS GOOD ENOUGH SMARTS TO LEAVE HIM ASAP!!!!! LIKE YESTERDAY WAS NOT SOON ENOUGH.     I never suggested that Mr. Smith should have had a $3,000,000.00 bail. The topic was EQUAL Justice.

    Edith Delgado should have a trial before she is convicted. She is an 18 year old child with 4 months driving experience under her belt.

    Not much experience…….

    80-85 MPH on our freeways today in not uncommon.

    Whether or not she was drag racing or even racing anyone remains to be seen.

    I personally believe she has a NO BAIL status with the current bail, thats all.

    Not Equal treatment.

    You can’t have equal justice with inequal crimes.

    $3M bail for 3 deaths is actually pretty light.

    So, what you’re saying is she wasn’t racing, BUT she was doing 80-85 MPH which is not uncommon on our freeways these days? 80-85 MPH, is far too fast for an inexperienced driver. Many of us experienced drivers do travel that fast on the freeway, but when you don’t have lot of driving expereince, that is a deadly accident waiting to happen….oh, my bad, it did! DUH!

    Trench is absolutely right these two cases are apples and oranges. If you wanted to argue the merits/validity of the case you are supporting, you probably should compare it to something….well…..comaparable…

    okay…hers a scenerio..

    I fly down the freeway at 85-90 mph with little driving experience. I strike a car driven by one of YOUR family friends, and two of YOUR relatives. A judge sets my bail at $3,000,000. But oh yeah, no one knows if I was “just speeding or actually drag-racing”. Its unconstitutional for my bail to be set so high, isn’t it?!?! Remeber, its not uncommon to drive at that speed. YEAH RIGHT.

    BECAUSE of HER actions, no one elses, three people lost their lives. And again, HER family and HER friends need to shut the hell up with all that “goody-good student/voulunteer” sh-t. I guess getting good grades in a CONTINUATION HIGH school makes it okay to hit people on the freeway. Little girl cant cut it in regular High School, goes to continuation, mommy buys her a mustang that she doesn’t know how to drive, she kills 3 people, and now she’s NOT GUILTY!!??!?!?! WTF!!!

    First off, the two incidents described can not be used to in a comparison to show unequal justice. A minor traffic accident in no way can compare to the carnage Edith caused. SHE KILLED THREE PEOPLE!!! The question of whether or not she was racing should not be a factor. The fact is she was driving wrecklessly at a high speed and caused a very serious accident is the only fact that matters.

    Bail is set on the basis of keeping the community safe. If she poses a high risk`of harming others, which she does, obviously bail is going to be set in a larger amount. It’s not the judicial system’s fault that she is unable to pay. BTW bail was reduced to 1 million.

    I would rather have someone who would flee a scene of a minor traffic accident driving on the road then a person who killed three people. I hope Edith is found guilty and serves everyday that she is sentenced in prison.

    People don’t feel sorry for their wrong doings until they are punished for them, and if they are not punished, they continue to do wrong. She needs to be punished.

    Speakin as one of edith’s good friends. I know she meant no harm or intented to kill three people. yes it is a very tragic story. However, this is something that happened and things happen for a reason. whether or not she in an experinced driver or not that means absolutely nothing. old people get behind the wheel all the time and cause just as much deaths as a young person can. She is a beatiful woman inside and out. This incident should not make her a evil person. She will make it and she will be set free. and she will take this on with her the rest of her life. God has already forgiven her. so she will move on and take it day by day

    YEA I AGREE WITH YOU RAQUEL. AND HER GOING TO A CONTINUATION H.S HAS NOTHING TO DO WITH THIS CASE!! NO ONE IS 2 JUDGE FOR HER PERSONAL LIFE BECAUSE NO ONE KNOWS THE REASONS OF HER NOT BEING ABLE TO COMPLETE HER EDUCATION AT A REGULAR H.S. BUT LIKE RAQUEL SAID, IF GOD HAS FORGIVEN HER THEN ALL YOU SHOULD JUST STOP JUDGING AND LIVE YOUR OWN LIFES BECAUSE YOU NEVER KNOW IF THIS COULD HAPPEN TO YOUR KIDS…THEN YOU WILL VIEW THINGS A LOT DIFFERENTLY.
