Teen will be tried as adult in Benton County rape case:

The other day I posted about James Wamsley the 17-year-old that is accused of raping a 9-month old baby. It garnered a lot of traffic to this site so now I’m playing catch up on the information. This is an article from a week ago that states that Wamsley is going to be tried as an adult. How could you not in this case? I would love for someone to tell me why he shouldn’t be tried as an adult. It wouldn’t be the first time that a teen committed such a heinous crime while people cry and whine that he needs “help” not prison.

A trial date of July 23rd has been set.

  1. Oh, alright, I’ll give it a shot. Here’s why you don’t charge children as adults.

    For the EXACT same reason you’re such a big fan of age of consent laws. At 17 years old the mental/emotional development into adulthood is still not complete. Any neuroscientist or developmental physchologist will agree with that statement. This is the reason that we have a seperate justice system for those under 18.

    It is not the heinousness of the crime that should be used to determine the culpability of the defendent, but rather independent phychological evaluation. If he is to be charged as an adult, it must be because the state believes that his mental and emotional development was complete at the time of the crime.

    That said, the heinousness of the crime should be taken into consideration in terms of sentencing. It isn’t something we should ignore, but it simply should not be the determining factor in deciding the defendant’s status as an adult.

    Every other part of our law say that a 17 year old is NOT an adult. If we’re going to contradict ourselves, we’d better have significant proof. Mere outrage at the crime itself is not reason enough.

    I go on both sites and you are right Trench peole do say that. But it is wrong this child needs help but he needs it in prison. This should not be a society where you do a horrible crime, claim insanity or young age, and get away with it. Although it starting to seem like it. Especially when I heard the latest Microwave baby story, the mom only said The Devil Made Him Do It cause she wants him to be let go for insanity. It only make sense that our world is insane.

  3. First, help in prison does not exist. Prisons are places to place people who are otherwise seen as unfit for general society, not to help them in any way whatsoever. Trust me, there is no help in prison there’s no night out in the jail.

    David is completely right. You try him as a minor because he is a minor. If he were an adult, he’d be tried as an adult. Little to explain outside of that…but the earlier comment takes care of it anyhow.

    I live in Spokane, WA. He was acting as an adult when he forcefully had SEX with a BABY.

    RAPED A BABY BOY.

    He deserves to be thrown to the babys family and let them torture him to death.

    If you commit a crime, you deserve punishment. If you think you are big enuff to commit it, you’re big enuff to pay.

    My “friend” in High school murdered his little sister and her friend…and he thought he’d get a few years because he was 15, so it was OK.

    Sad thng is, he was in an institution till he was 18, then sent to prison till 25, then RELEASED.

    Fucking bullshit.

    You want to rehabilitate these sickos…and spend OUR money…the FAMILIES, the VICTIMS money to do so.
