Lawyers take school shooting case to Mo. Supreme Court:

The lawyers for Thomas White are appealing to the Missouri Supreme Court to have White tried as a juvenile.

Public defenders said Monday they have appealed to reverse a lower court’s July decision that Thomas White, 14, should be tried as an adult. He faces four felony counts related to the school shooting last October and a charge of attempted escape from juvenile custody.

White was 13 at the time of the shooting at Memorial Middle School.

Nobody was injured when White allegedly fired a single shot into the ceiling. Prosecutors allege that White repeatedly tried to shoot the school’s principal but that the gun jammed.

The public defenders are just delaying the inevitable. Now all court proceedings will be postponed until the state supreme court issues a decision or reverts the case back to a lower court. My prediction is that the Missouri Supreme Court will more than likely refuse to hear the case.

If they do hear the case I’m sure they’ll get a bunch of tear-stained letters from suburban housewives who think no teen is capable of murder. Just on that possibility alone, I wouldn’t hear the case if I was a Justice.

    He fired it at the ceiling, you generally don’t kill people when you fire a gun at the ceiling. There is no evidence that he ever pulled the trigger at the principal, even the principal admits that he does not know (how the prosecutors can know otherwise is beyond me but needless to say they will have a hard time proving it beyond reasonable doubt in court when the principal even admits he does not know.)

    P.S. Trench just so you know that newspaper article lied in another area. It said he faces blended sentencing if convicted, as it is now blended sentencing is only a possibility not a sure thing. I just love it when our media lies to us.

    Then let him be charged with what he did Jim, not with assult or attempted murder like you have argued before. Firing a gun into the ceiling and not hurting anyone does not amount to first degree assult. And certainly does not amount to adult certification.

    The question is do you think a developmentaly delayed 13 year old is really an adult? Do you think a 13 year old is an adult at all? Would you trust a 13 year old of any kind to vote? Would you trust him to drink, to smoke, to drive? Hell if he would have stopped going to the school that he considered so bad he would have still gotten in trouble because we deem that he is not old enough to do that.

    By law he can’t even understand sex or at least consent to it (yes I know there will be a pedo joke about that, should be funny) but yet he is deemed old enough to fully understand the reaction of shooting a gun into a ceiling. Let him be charged, but let him be charged as a child until you give him, and all others of his age, all the rights we generally associate with adulthood. Until then he is a kid, call me retarded all you want but don’t even pretend he is an adult.

    Plus I believe there are these things called “laws”, maybe you’ve heard of them, that prevent 8-year-olds from being tried as adults.

    How do you know what White’s intention was? He shot at the ceiling. Now something tells me even if he had never shot a gun before he could aim it slight better then at the ceiling. Though we both know it will be hard because they would have been certified as kids and records would be sealed.

    And actually several states have no min. age for certification as adults, so yes 8 year olds could be tried as adults. I believe Djinn Buckingham was only 11 when he was certified at least temporarily as an adult(though I am not sure, everyone has dropped his case for some reason.)

    Though once again you dodged the question, the question is do you feel that an 8 year old tried with first degree assult involving a deadly weapon should be tried as an adult?

    Before you ask check out that site, New Mexico is one example of a state that does not have a min age if you want one. And if you want to go by what most states do, most states have the age at 14, older then Thomas White.

    Buckingham did not intentionally start the fire with the purpose to kill if he is to be believed.

    White on the other hand procured a gun, loaded the gun, brought the gun to school, discharged the gun in the school, and tried to fire the gun had it not jammed, and tried to clear the jam but couldn’t.

    But I’m sure you still won’t be able to see the difference.

    Let’s look at Missouri’s shall we…

    Missouri

    Lower Age: None specified

    Upper Age: 16

    Discretionary Waiver Mo. Stat., Tit. XII, Sec. 211.071

    Upon its own motion or that of any party in the case of a child of at least 12 accused of a felony, the juvenile court may order a hearing to consider whether to dismiss the delinquency petition and transfer the child for adult prosecution. (However, the court must at least hold a hearing to consider transfer where the child is accused of one of a number of listed offenses—first or second degree murder, first degree assault, forcible rape, forcible sodomy, first degree robbery, or distribution of drugs—or has committed two or more previous felonies.) Before the hearing, a written report on the child ‘s history, record, offense, rehabilitation prospects, etc., must be prepared for the juvenile court’s consideration. Following the hearing, the court may dismiss the case to permit adult prosecution if it finds that the child is not a proper subject to be dealt with under the juvenile law, taking into account a number of determinative considerations (including “racial disparity in certification”) specified by law. An order of dismissal to permit adult prosecution must be supported by written findings.

    Offense Category Minimum Age Offense Detail

    Certain Felonies 12 Any felony.

    Once an Adult, Always Mo. Stat., Tit. XII, Sec. 211.071

    Once the juvenile court has dismissed a petition to permit prosecution of a child as an adult, its jurisdiction over that child with respect to future offenses is forever terminated, unless the child is subsequently found not guilty in adult court.

    So according to Missouri law, an 8-year-old can be tried as an adult for first-degree assault. Depending on the severity of the damage I have no problem with that.

    Though once again prove that he tried to fire the gun at someone. You can prove the gun jammed, I get that, but you can’t prove he intentionally tried to kill someone. Now stop making up shit and debate me on the basis of the facts not on what you feel or what you believe happened.

    The difference I see is that Buckingham killed someone and his actions could have easily killed someone. White on the other hand fired a gun into a ceiling so while a freak accident could have killed someone nothing else could have.

    You posted on here a while back about a guy who brought a gun to school, fired it into the ceiling, then shot himself. That goes to show you that there are other legimate reasons you would shoot a gun into the ceiling. Like as White has maintained (at least as much as his lawyers have allowed) that his only intention in bringing a loaded gun to school and shooting it off was to get expelled.

    Unless you can prove that he pulled the trigger when it was pointed at someone you have nothing then your own beliefs, and those won’t get you far in court.

    Nah, I don’t think we can claim a moral superiority here. I feel we are just about as barbaric when it comes to prosecuting children as they are. Remember it was just about 5 years ago when we could execute kids. Even still we believe in sentencing extremely young kids to life in jail. Then you look at the cases of the King brothers where there is much probable doubt that they ever even committed a crime, even the orginal jury just believe they witnessed it. Or you look at people like William Thorton who was sentencing to 30 years in jail for running a stop-sign that claims several lives ever year. Or at this case where we have a pretty severely delayed 13 year old boy being prosecuted as an adult. Where is our moral superiority?

    Oh no no no, enders says its not murder if you are under 18 years old because you cant vote yet.

    In a world run by Endersdragon, kids can kill anything (except other kids with disabilities) they want and not be charged with the crime because they are not adults yet. I suppose that the worse off they are the more crime they can commit and be good with the law. For example, a 10 year old can kill shouldn’t get jail time, but a 13 year old with down’s who kills should get a free house and not have to pay taxes. Apparently the shorter you are, and the longer your forehead … more thicker your shielding should be from the law.

    and that makes perfect sense.

    Now Enders, be a good boy and go kill yourself. Your schoolmates hate you, we hate you, your mommy hates you and you have nothing to live for. If you need tips on how to do it pain free, let me know… I have some ideas for you.

    But there is no evidence (not a single bit) that the King brothers killed anyone other then a confession that even the prosecution believes was a lie. And killing a stoned/drunk person who was most likely speeding by running a near impossible to see at night stop-sign that claims several lives every year seems to not be worth a 30 year sentence? Do you think those cases are justice?

    I think the age of adulthood is 18. But beyond that yes there are people under 18 who should be tried as adults. These do not however amount to delayed 13 year olds like you would like to believe. A delayed 13 year old in no way, shape, or form is an adult. If it was a 35 year old with the mental processing ability of a 11 year old (which I think is a very liberal estimate of where Thomas actually functions, he is actually probably much lower in many ways) would we be talking about punishing them to fullest extent of the law. Well you might but most sane people wouldn’t

    And I will kill myself as soon as you get me a shot at you. What can it hurt, you don’t believe a retard like me can shoot do you?

    the King brothers didn’t kill, they only confessed to it and the people who are STILL trying to put them away don’t believe it. Thats why they are still trying to put them away.

    Killing inebriated people is ok as long as you can pretend to not have seen a stop sign that you obviously knew was there anyway because the same stop sign has been in the news several times before.

    I like this site quite a bit. I come here about once a week to reinforce my view that humanity is evil. As such, I do not wish to get banned. However, I must speak up in defense of Endersdragon. Some of his points are valid, and he really didn’t seem to start anything he only responded. The VAST majority of insults were slung at him rather than by him. I have no proof, for or against, the claim that he has Asberger’s Syndrome, and I frankly don’t give a damn either way. His sexuality is of even less importance in a rational debate. I’ve never thought of this site as scholarly, and it’s a pleasant change from some of my other haunts, but could you at least be respectful toward someone who has not, to the best of my (admittedly extremely limited) knowledge, done anything other than try to challenge your views?

    In the interest of full disclosure, I admit that I am personally offended by the comments that make fun of mental health problems and terminology. I have a sister who is somewhat retarded, and it biases me.

    makes me appreciate his contributions a lot less. I know a number of people with all sorts of disorders and syndromes, and all of the ones who are in touch with reality (several of them are very low-functioning autistics) know not to use the diagnoses as a shield. An explanation is one thing, but using them as shields makes us all look bad.

    With that said, I still think he is, or perhaps was, in the right this time.

    No, thank goodness. If he contacted me somehow, I’d probably download a couple of viruses and email them to him. Make no mistake, I consider him a pissant. However, pissants can make good points, and devil’s advocates usually do far more good than bad.

    And on a side note, he mentions in #8.1.1.1 that he’s willing to kill himself, even if that wasn’t his intention.
