Judge again rules against use of jailhouse conversations in Odgren case:

On Friday a judge ruled once again that the taped jailhouse conversations of John Odgren. Previously prosecutors asked for all the tapes but this time they narrowed their request to 10 to 15 hours of tape.

Prosecutors want the tapes to show that Odgren doesn’t really have Aspergers which is the key to his defense.

  1. First, the links bad. Second, he doesn’t have a disorder that he was diagnosed with at a young age. Thats interesting. I could see proving that asperger’s doesn’t make someone a criminal, but that he doesn’t have it will be hard to prove.

  2. After reading that article (after searching for it) I must say I hate the phrase it when someone says that Asperger’s people speak a certain way. We are all different.

  3. Since there is no real definitive test for Aspergers I think it would be rather easy to prove or at least argue that it’s been over diagnosed like ADD.

Possibly, but if I remember correctly he was diagnosed at a quite young age with it and for many years the school district never argued that diagnoses (which the school district almost always argues the diagnoses if there is any doubt as an aspie typically can argue for more accomadations then others hence more expensive). It is only when he gets to court that they say, “Well he doesn’t sound like an aspie.” And this after God knows how much therapy to make him not sound like an aspie (I have met many aspies in my day that you have to look many times to realize they are an aspie). I am sorry but I am not buying this arguement.

  6. Ummm where did I say that and where are they argueing that? Asperger’s in and of itself doesn’t make one homicidal, but compounded with other issues it easily can. Like I said, I just want the truth in this case. I have heard plenty of stories of aspie kids playing around with knifes at school but I am not sure thats what happened here.

  9. That’s what the defense attorney’s main strategy is. And again Aspergers as a murder defense has never worked.

  10. My problem isn’t with Aspergers patients but with people trying to use it as a defense for murder. I also have a problem in case where it’s been overdiagnosed or self-diagnosed. Just because someone is socially inept isn’t an automatic Aspergers case.

    Plus Enders doesn’t have it anyway.

  11. Thats not entirely true. Its never gotten someone completely off but it has lessened penalities before.

  12. No I have NVLD, but once again you can’t tell me the difference and I have never read a book about Asperger’s where NVLD is not also mentioned and said to be practically the same thing.

  14. Actually some books I have read argue that they are the exact same thing but your point is taken. I classify myself as an aspie because no on knows what NVLD is and when they are/almost the same thing it makes more sense to use the word that people know. Sortof like if someone had Fragile X syndrome would you really critize him for calling himself autistic?

  15. The flaw in your argument about Asperger’s contributing to making people violent or criminal is this: To prevent them from commiting a crime, at diagnosis, they should all be locked up and the key shoudl be thrown away.
