

State’s highest court reinstates parental kidnapping charge against father of missing Lynn boy:
It’s been a long time that we’ve heard any news in the story of missing child Giovanni Gonzalez. As a matter of fact, it’s been almost a year to the day.
Quick recap, in 2008 a then 5-year-old Giovanni spent the weekend with his father in Lynn, Massachusetts. When it came time to be returned to his mother Ernesto Gonzalez said he didn’t know where Giovanni was and hasn’t given his location since. Ernesto Gonzalez has claimed that he killed his son but police say there is no evidence to support that. I can’t believe that Giovanni has been missing now for four years.
In my last post about Giovanni, I posted about how the parental kidnapping charges against Ernesto Gonzalez had been dropped against him because a Superior Court judge stated that Ernesto Gonzalez did have parental rights to Giovanni since he had paid some child support and filed for joint custody.
This past week the parental kidnapping charges have been reinstated against Gonzalez.
The high court, in a 15-page opinion written by Justice Barbara Lenk, said it didn’t have to reach the constitutional question because another part of the law also provides that if “either parent relinquishes or abandons the child and the other parent is fit to have custody, that parent shall be entitled to custody.”
The court said Gonzalez had been absent for three years from his son’s life, including a one-year complete disappearance. He had sought permission from the mother to have weekend visits with his son. His son disappeared on the third visit with him, in mid-August 2008.
While this is good new unfortunately it doesn’t bring Giovanni back to his mother, Daisy Colon, who still believes that Giovanni is alive.
